Terms & Conditions

These Terms govern the use of getlucky.company and the purchase of products from The Lucky Company. Our operations are subject to Colombian Law 1480 of 2011 (Consumer Statute) and complementary regulations.

1 · Acceptance

By accessing, browsing or making a purchase on the website https://getlucky.company, as well as through our official sales channels (WhatsApp, Instagram, TikTok, Facebook/Meta), you (hereinafter, the "User" or "Consumer") expressly, informedly and unequivocally accept these Terms and Conditions.

If you do not agree with all of these terms, please refrain from using our services. The Lucky Company reserves the right to modify, update or add to these Terms at any time. The current version will always be the one published on this site.

3 · Products and Availability

The Lucky Company sells clothing and accessories in the streetwear category, including t-shirts, hoodies, sweatshirts and caps, in limited editions.

The availability of sizes, colors and designs is subject to inventory and may run out without prior notice. Since these are limited productions, we do not guarantee the restocking of a sold-out reference.

The published images are illustrative references. Colors may show minimal variations due to photographic lighting, screen calibration or artisanal printing processes, which does not constitute a manufacturing defect.

4 · Pricing and Currency

All prices are expressed in Colombian Pesos (COP). The Controller operates under the Not Liable for VAT regime (Code 49) per its Colombian tax registry (RUT), therefore prices do not include billable VAT. For international purchases, currency conversions and destination country duties may apply.

Prices do not include shipping costs, which will be quoted and confirmed prior to purchase. We reserve the right to modify prices at any time. In the event of an obvious typographical error, we will contact the Consumer to correct or cancel the order.

5 · Purchase Process

The Lucky Company currently does not operate with an automated shopping cart. The entire sales process is assisted via WhatsApp or Direct Message (DM) on Instagram/TikTok.

  1. The User selects the product, size and color.
  2. We confirm availability and total value (product + shipping).
  3. The User makes the payment through the authorized methods.
  4. Once the payment is verified, we proceed with preparation and shipment.

The purchase contract is perfected only upon confirmation of effective payment by The Lucky Company.

6 · Payment Methods

We accept the following payment methods in Colombia: Bank transfer (Bancolombia), Nequi, Daviplata, Wompi and secure payment links. For international purchases, payment will be coordinated via payment link or transfer.

The Lucky Company does not store card data or sensitive financial information. Processing is performed directly with the payment gateway. Shipment is made only after payment verification.

7 · Shipping

Domestic Shipping (Colombia). Estimated delivery time is 3 to 7 business days from dispatch.

  • Main cities (Barranquilla, Bogotá, Medellín, Cali): 2 to 5 business days.
  • Remote or hard-to-reach areas: 5 to 10 business days.

International Shipping. Times and costs are quoted individually based on the destination country, through carriers such as DHL, FedEx or partners. Estimated time is 7 to 20 business days. The Consumer is responsible for any customs duties or import taxes in the destination country.

The Consumer must provide complete and accurate delivery information. The Lucky Company is not responsible for delays attributable to the carrier, force majeure, public order, or erroneous delivery data provided by the customer.

8 · Right of Withdrawal (Art. 47 Law 1480/2011)

In accordance with the Colombian Consumer Statute, in sales using non-traditional or distance methods (including WhatsApp and social networks), the Consumer has the right to withdraw from the purchase within five (5) business days following delivery.

To exercise withdrawal, you must:

  • Notify within the term via admin@getlucky.company or WhatsApp.
  • Return the product in the same condition as received: unused, unwashed, odor-free, with all its original tags, packaging and accessories.
Exceptions. The right of withdrawal does not apply to goods made according to the consumer's specifications or clearly personalized (e.g. prints with names, modified sizes, custom designs).

The refund will be made within thirty (30) calendar days following the request, through the same payment method used, deducting transportation costs (shipping and return) which, by law, must be assumed by the Consumer, unless the cause is a product defect or error attributable to The Lucky Company.

9 · Legal Warranty

In accordance with Articles 7, 8 and 11 of Law 1480 of 2011, all our products have a legal warranty of thirty (30) days from delivery, for manufacturing defects, quality or suitability.

The warranty covers stitching defects, zippers, abnormal fabric shrinkage or factory printing defects. It does not cover: natural wear and tear from use, damage from improper washing, use of bleaches, improper ironing, tears, discoloration from sun exposure, or damage caused by misuse by the Consumer.

To make the warranty effective, the customer must contact us with photographic or video evidence of the defect.

10 · Exchanges and Returns

Size exchanges. Accepted within 5 business days after delivery, provided the product is in perfect condition and subject to inventory availability.

The cost of return shipping and new shipping will be borne by the customer, except when the exchange is due to an error by The Lucky Company or a defect covered by the legal warranty.

No refunds are made for change of opinion, size or color outside the right of withdrawal. Procedure: write to WhatsApp indicating order number, reason and attach photos of the product.

11 · Intellectual Property

The brand "The Lucky Company", its logos, graphic designs, illustrations, photographs, texts and other content of the website and social networks are the exclusive property of Jurgen Andres Cantillo Mier and are protected by the Industrial and Intellectual Property regulations of the Republic of Colombia and international copyright treaties.

Their reproduction, distribution, commercialization, transformation or unauthorized use without prior written consent is strictly prohibited.

12 · Site Use and Prohibited Conduct

The User commits to making lawful and appropriate use of the site. It is prohibited to: impersonate third parties, attempt to access restricted areas, introduce viruses or malware, perform scraping, copy our designs for resale, or use our platforms for fraudulent or illicit purposes.

13 · Limitation of Liability

The site is offered "as is" and "as available". The Lucky Company does not guarantee that operation will be uninterrupted or error-free.

In no event will we be liable for indirect, incidental, consequential damages, lost profits or loss of opportunity arising from the use of our products. Our total and cumulative liability against any claim will be limited, at most, to the value actually paid by the Consumer for the product subject to the dispute.

14 · Third-Party Links

Our site and social networks may contain links to third-party platforms such as Instagram, TikTok, Facebook (Meta) and WhatsApp. The Lucky Company does not exercise control over such sites and assumes no responsibility for their contents, privacy policies or commercial practices. The use of these links is at the User's risk.

15 · Governing Law and Jurisdiction

These Terms and Conditions are governed and interpreted in accordance with the laws of the Republic of Colombia, especially by Law 1480 of 2011 (Consumer Statute), Law 1581 of 2012 (Personal Data Protection) and other complementary regulations.

Any controversy will be submitted in the first instance to the Superintendence of Industry and Commerce (SIC), and subsidiarily, to the competent judges of the city of Barranquilla, Atlántico, Colombia, with the User waiving any other jurisdiction.
